1. Acceptance of Terms
By creating an account, accessing, or using BudgetIQ ("the Service"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter binding contracts. By using the Service you represent and warrant that you meet these requirements.
3. The Service
BudgetIQ is a personal budgeting SaaS application providing manual entry, statement imports (CSV, Excel, PDF, receipt images), automated categorisation, reporting, and AI-generated insights. The Service is provided on an "as is" and "as available" basis.
4. Free Trial
New users receive a two (2) month free trial commencing at account creation. No payment method is required to start the trial. Access to paid features ends automatically at the end of the trial unless the annual plan is activated.
5. Fees and Payment
The Service is offered on a once-off annual subscription of ZAR R450 per user (charged in the equivalent local currency at prevailing exchange rates), granting twelve (12) months of full access from the date of payment. An early-upgrade price of ZAR R350 (or the local-currency equivalent) is available while thirty (30) or more days of the free trial remain. Fees are non-refundable except where required by law or as set out in our Refund Policy. We may change pricing prospectively; existing paid periods are not affected.
5A. Refund Policy
Because the two-month free trial gives you full access to evaluate the Service before paying, annual subscription fees are non-refundable once activated, except where a non-waivable statutory right applies in your jurisdiction. If you believe you were charged in error, or if a mandatory consumer-protection law grants you a refund right, contact billing@budgetiq.app within fourteen (14) days of the charge and we will review your request in good faith.
6. User Accounts and Security
You are responsible for safeguarding your credentials and for all activity under your account. You must notify us immediately of any unauthorised access. We are not liable for losses caused by unauthorised use of your account arising from your failure to keep credentials secure.
7. Acceptable Use
You agree not to (a) reverse engineer, decompile, or scrape the Service; (b) upload malicious code; (c) use the Service to infringe intellectual property or applicable law; (d) attempt to gain unauthorised access to other accounts or systems; (e) resell or sublicense the Service without written permission.
8. Your Data
You retain ownership of all financial data you upload. You grant BudgetIQ a limited licence to process that data solely to operate the Service, including using AI models to categorise transactions and generate insights. You are responsible for the accuracy and legality of the data you upload.
9. AI-Generated Content
Insights, forecasts, and categorisations produced by AI are provided for informational purposes only and are not financial, tax, investment or legal advice. You are solely responsible for decisions made based on such output.
10. Third-Party Services
The Service integrates with third-party providers (authentication, payment processing, AI inference, hosting). Your use of those integrations is subject to the applicable third-party terms in addition to these Terms.
11. Intellectual Property
All rights, title and interest in the Service, including software, design, trademarks and content (excluding your data), remain the exclusive property of BudgetIQ and its licensors.
12. Termination
You may cancel your account at any time. We may suspend or terminate your account for material breach of these Terms, for suspected fraud or abuse, or where required by law. On termination you may export your data for thirty (30) days, after which it may be permanently deleted.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
14. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability under these Terms shall not exceed the amount you paid to BudgetIQ in the twelve (12) months preceding the event giving rise to liability. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or data.
15. Indemnity
You agree to indemnify and hold BudgetIQ harmless from any claim arising out of (a) your breach of these Terms, (b) misuse of the Service, or (c) violation of any law or third-party right.
16. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least fourteen (14) days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
17. Governing Law
These Terms are governed by the laws of the jurisdiction in which BudgetIQ is registered, without regard to conflict of laws principles. Disputes shall be resolved in the competent courts of that jurisdiction.
